HomeTerms of Use

An experimental beta, with clear boundaries.

These Terms govern your access to and use of eMidas. eMidas is an untested beta proof of concept for personal, non-commercial research. It is not financial advice. Please read these Terms carefully, especially sections 2, 4, 13, 14 and 15, which limit our liability and set out your responsibilities.

Effective and last updated: 5 October 2026 · Version 2026-10-05
01

Agreement, definitions and acceptance

These Terms of Use (the “Terms”) form a legally binding agreement between you and the operator of eMidas (“eMidas”, “we”, “us” or “our”). “Service” means the eMidas website, application, APIs, emails, alerts, content and every related feature. “Developers” means the individuals who create, develop, maintain, host or operate the Service, together with our and their contributors, contractors, affiliates, successors and assigns.

You accept these Terms by ticking the acceptance box when you create an account, by accepting an updated version, or by otherwise accessing or using the Service. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal information and forms part of these Terms.

02

Beta, proof of concept and not fully tested

The Service is an experimental beta and proof of concept. It has not been properly or fully tested, audited or certified, and it is not a finished, production or commercial product.

You acknowledge and accept that the Service:

  • may contain bugs, errors, security vulnerabilities, inaccurate calculations and incomplete features, and may behave unexpectedly;
  • may produce wrong, misleading, stale or inconsistent prices, indicators, backtest results, optimisation results and alerts;
  • may be changed, interrupted, reset, rate-limited, suspended or discontinued at any time, with or without notice;
  • may lose, corrupt or delete your data, including accounts, strategies, layouts, watchlists, alerts and history, and is not backed up for your benefit; and
  • is offered free of charge to demonstrate a concept and gather feedback, and is not supported by any service level, maintenance or support commitment.

You must not rely on the Service for any purpose where an error, omission, delay or outage could cause loss, harm or damage. Keep your own independent copies of anything you value.

03

Eligibility and personal, non-commercial licence

You must be at least 18 years old and have full legal capacity to enter into these Terms. You must not use the Service if doing so is prohibited where you live or by any law, regulation or sanction that applies to you.

Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to use the Service solely for your own private, non-commercial research and education. Commercial use is strictly prohibited. Without our prior written consent, you must not use the Service, or any output of it:

  • on behalf of, or for the benefit of, any business, fund, client or other third party;
  • to provide investment advice, signals, portfolio management, trading or any other paid or professional service;
  • to make, execute or automate real-money trading or investment decisions; or
  • to resell, sublicense, white-label, rent or otherwise commercially exploit the Service or its output.

Any use that breaches this section is unauthorised and is entirely at your own risk and liability.

04

Not financial advice and no reliance

eMidas is not a broker, dealer, exchange, investment adviser, financial planner, fiduciary or regulated firm of any kind, and is not authorised or regulated by the Financial Conduct Authority or any other regulator. Nothing in the Service, including any data, chart, indicator, strategy, template, score, backtest, optimisation, alert, email, AI output or other content, is or should be treated as financial, investment, trading, tax, accounting or legal advice, a personal recommendation, or an offer or solicitation to buy, sell or hold any asset.

Trading and investing, including in cryptoassets, involves a substantial risk of loss, and you may lose all of the money you invest. Past or simulated performance is not a reliable indicator of future results. You are solely responsible for your own decisions, for independently verifying any information, and for obtaining advice from an appropriately authorised professional before acting. You agree that you do not rely, and will not rely, on the Service when making any financial decision.

05

Backtests, simulations and alerts

Backtests, optimisations and simulations are hypothetical. They are based on historical data, simplifying assumptions and code that may contain errors, and they may ignore or misstate fees, spreads, slippage, liquidity, funding, taxes, market impact, outages and other real-world effects. Optimised strategies are especially likely to be overfitted and to perform worse in the future.

Alerts and notifications are provided on a best-efforts basis only. They may be late, duplicated, incorrect or not delivered at all, and scheduled scanning may be paused or disabled. You must not depend on an alert to manage any position or risk.

06

Market data and third-party services

Market data and other content are supplied by third parties, including Yahoo Finance, Twelve Data and Binance, and the Service relies on third-party infrastructure, email, authentication and AI providers. We do not control and are not responsible for third-party data or services, which may be delayed, inaccurate, incomplete or unavailable and may be subject to their own terms. Market data is provided for personal, informational use only and must not be redistributed.

07

AI-assisted features

Optional AI-assisted optimisation uses a third-party large language model. AI output can be wrong, fabricated, biased, inconsistent or unsuitable, and it is not reviewed by a human before you see it. Treat every AI suggestion as an unverified hypothesis. AI-generated changes are never applied or traded automatically, and you are solely responsible for any use you make of them. AI features may be limited, rate-capped or withdrawn at any time.

08

Accounts and security

Provide accurate information and keep it up to date. Keep your password confidential, use a unique password, and tell us promptly about any suspected unauthorised use. You are responsible for all activity under your account. We may refuse, limit, lock or close accounts, for example after repeated failed sign-in attempts, to protect you, other users or the Service.

09

Acceptable use

You must not, and must not help or allow anyone else to:

  • probe, scan, test or exploit the vulnerability of the Service, or breach or circumvent any security, authentication, rate limit, usage cap or access control;
  • access or attempt to access another person's account or data, or collect information about other users;
  • use bots, scrapers or other automated means to access the Service, except through features we expressly provide;
  • copy, modify, decompile, reverse engineer or create derivative works of the Service, except to the extent the law expressly allows;
  • overload, disrupt or interfere with the Service or its providers, or deliberately consume excessive data, email or AI resources;
  • upload malware or any unlawful, harmful, infringing, deceptive or offensive material, or impersonate anyone; or
  • use the Service for market manipulation, fraud, money laundering, sanctions evasion or any other unlawful purpose.

If you believe you have found a security vulnerability, report it privately to us and do not exploit or disclose it.

10

Your content and feedback

You keep ownership of the strategies, configurations and other content you create (“Your Content”). You grant us a worldwide, royalty-free licence to host, store, copy, process and display Your Content as needed to operate, secure and improve the Service. You are responsible for Your Content and confirm you have the right to use it.

If you send us ideas, suggestions or other feedback, you grant us a perpetual, irrevocable, royalty-free right to use it for any purpose without obligation to you.

11

Our intellectual property

The Service, including its software, design, text, graphics, logos and the “eMidas” name, is owned by us or our licensors and is protected by intellectual property laws. Apart from the limited licence in section 3, no rights are granted to you.

12

Changes, availability and data loss

We may change, add, remove, suspend or discontinue any part of the Service, impose usage limits, or reset or delete data at any time, including at the end of the beta. To the fullest extent permitted by law, we are not liable to you for doing so.

13

Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is”, “as available” and “with all faults”, without any warranty, representation, condition or guarantee of any kind, whether express, implied or statutory. We and the Developers specifically disclaim all implied warranties and conditions of satisfactory quality, merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, title, non-infringement, security and uninterrupted or error-free operation, and any warranty that the Service or its output is reliable, free from viruses, or will meet your requirements.

14

Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited, including your statutory rights as a consumer.

Subject to that, and to the maximum extent permitted by law: (a) neither we nor any Developer will be liable to you, whether in contract, tort (including negligence), breach of statutory duty, misrepresentation or otherwise, for any trading or investment loss, loss of profit, revenue, opportunity, savings, goodwill or reputation, loss or corruption of data, cost of substitute services, or any indirect, incidental, special, consequential, exemplary or punitive loss or damage, even if foreseeable or if we were told it was possible; (b) neither we nor any Developer will be liable for any loss arising from your reliance on the Service or its output, from data supplied by third parties, from alerts that are late or not delivered, from unauthorised access to your account, or from any commercial use of the Service; and (c) the total aggregate liability of us and all Developers together, for all claims arising out of or relating to the Service or these Terms, will not exceed the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim and fifty pounds sterling (£50).

You agree that these limits are reasonable given that the Service is a free, experimental beta, and that they apply to each Developer personally as well as to us.

15

Your responsibility and indemnity

You use the Service entirely at your own risk. To the extent permitted by law, you agree to indemnify, defend and hold harmless us and every Developer from and against all claims, demands, losses, liabilities, damages, fines, costs and expenses (including reasonable legal fees) arising out of or relating to: your use or misuse of the Service; any decision you make or action you take based on it; any commercial use; Your Content; your breach of these Terms; or your violation of any law or the rights of any third party.

16

Suspension and termination

You may stop using the Service and delete your account at any time in Settings. We may suspend, restrict or terminate your access, or delete your account, at any time and for any reason, including breach of these Terms, suspected abuse or security risk, legal necessity or the end of the beta. Sections 2, 4, 5, 10, 11 and 13 to 19 survive termination.

17

Changes to these Terms

We may update these Terms from time to time. We will publish the new version here with a new version date. When a change is material, we will ask you to accept the updated Terms before you continue using the Service; if you do not accept them, you must stop using the Service.

18

Governing law and disputes

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or the Service are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer living elsewhere you keep the benefit of any mandatory protections, and any right to bring proceedings, under the laws of your country of residence. Before starting any formal claim, you agree to contact us first and try in good faith to resolve the dispute informally for at least 30 days.

19

General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service and replace any earlier understanding.
  • Severability. If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will stay in full effect.
  • No waiver. A failure or delay in enforcing any right is not a waiver of it.
  • Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours, including to a successor or acquirer.
  • Events beyond our control. We are not liable for any failure or delay caused by events outside our reasonable control.
  • Third-party rights. Each Developer may enforce sections 13, 14 and 15 under the Contracts (Rights of Third Parties) Act 1999. No other person has any right to enforce these Terms, and we may vary or end them without anyone else's consent.
  • Language. These Terms are written in English, which governs if any translation conflicts with it.
